Maine Coon and Bengal Kitten Agreement

Kittens on the Prowl Cattery, (hereinafter "seller/Breeder") and

(thereinafter "Buyer(s)", voluntarily enter and agree to all terms stated in this contract as witnessed by their signatures below.

Kitten/Cat being sold in consideration of $ -------------. paid to the Seller by the Buyer(s) in full by Cash, Credit Card, Venmo or Cash App.

This said Kitten/Cat, has been sold to buyer(s) as a "Pet Quality Prospect". This means that the Kitten/Cat shall be understood to mean that no disqualifying faults as defined in the breed standard are evident at the time of sale and further that no genetic disorders are immediately apparent.

We do realized due to unforeseen events in people's lives that things happen to make a family unable to get the Kitten/Cat they have pai for, any money sent towards the purchase of your Kitten/Cat is non-refundable. If paid in full you may choose a Kitten from another litter minus the deposit. You will have up to 1 year to use this money. When placing a deposit on a waiting list you will have 2 years to use that deposit, unless you have chosen a Kitten and back out of this agreement.

The final payment unless given 1 week in advance is given in cash only.

Undescended testicles, no heat cycles, ears not standing, coat not long enough, color change, overbite/underbite (unless affects the cats' ability to chew food properly), inability to breed, or Kitten does not get as big as customer had hoped are not covered in the serious genetic warranty.

\\\*SERIOUS genetic defect is one that will shorten the lifespan of the Kitten or deem the Kitten to be a medical haphazard and require continue health care.

2 YEAR HIP/ELBOW WARRANTY

Kitten/Cat in on Nuvet Supplements. If Kitten/Cat stays on these supplements, then Kittens on the Prowl Cattery will warrant his/her hips for the first 2 years of life. If Kitten/Cat does not stay on Nuvet Supplements, the warranty will fall back to the 1-year warranty.

BUYER UNDERSTANDS

If for any unforeseen reason the Queen does not become pregnant, have the sex or color they want, the deposit will carry over to the litter of their choice.

Kittens/Cats will come with a spay or neuter contract unless otherwise agreed upon. You will receive you Kitten/Cats registration paperwork after we receive the operative report from you veterinarians office with said Kitten/Cats name and registration number written on report. This MUST be done by 6 months of age. Have your veterinarian email it too: Kittensontheprowl@yahoo.com

BUYER AGREES TO THE FOLLOWING:

----- Kitten/Cat is being sold for $-----------, to be paid in full on or prior to delivery or pickup.

----- A non-refundable deposit of $500.00 is required to secure your Kitten/Cat. All deposits and monies for said Kitten/Cat will bein cash/CC/Venmo/Zell/Cash App. Deposit will be deducted from the total purchase price. If buyer is unable to pick up Kitten/Cat at 12 weeks of age, there will be an additional $5.00 boarding fee for each day the Kitten/Cat stays. If your Kitten/Cat is not picked up by 12 weeks of age, (unless we have discussed a plan for you), all money sent for this said Kitten/Cat will be non-refundable and the Kitten/Cat will be rehomed with someone else.

----- Buyer(s) agrees to have the Kitten/Cat examined by a Licensed Veterinarian of Buyer(s) choice within 72 hours of receipt of Kitten/Cat or the Health Warranty for this said Kitten/Cat is null in void.

----- An office visit report must be emailed or sent via postal service to the Seller within 1 week of the 72 hour exam by the Veterinarian, or warranty is null in void.

----- All claims must be made within this 72 hour period. Buyer(s) in completely satisfied with examination and appearance of Kitten/Cat if seller is not notified within 72 hours after receipt of said Kitten/Cat.

----- Kitten/Cat will be given all required inoculations, worming and care. Byer is made aware of the importance of keeping Kitten inside other than to visit Veterinarian visits prior to 1 month after 3rd vaccination have been give.

----- Kitten/Cat will stay on NuVet Supplements, or warranty will be good for 1 year.

----- Kitten/Cat will be excepted/treated as a family member.

----- Kitten/Cat will not be caged outside and will have free range of the home.

----- Buyer agrees to pay the shipper $--------, when said Kitten/Cat arrives at Buyers home or meeting place. Unless other arrangements have been made prior to shipment of said Kitten/Cat.

----- Buyer guarantee Breeder the right of first refusal if the Kitten/Cat is to be rehomed. Signed TICA registration papers must accompany the Kitten/Cat, when returned to Seller. Buyer(s) agrees not to sell, trade, lease out, euthanize (except under emergency conditions to end suffering), or give away the Kitten/Cat without the written permission of the Breeder.

SELLER GUARANTEES

Seller guarantees that side Kitten/Cat is in good health and has received appropriate medical inoculations, worming and care. Seller will provide Buyer(s) with medical chart detailing treatment Kitten/Cat has received under Seller's care, and any future care Seller feels is essential to Kitten/Cats well-being.

Seller guarantees that Kitten/Cat is free of life-threatening disease or disabilities for 72 hours after delivered to Buyer(s). Should life threatening disease or disabilities be discovered by Buyer(s) within 72 hours after receipt of Kitten/Cat and attested to in writing to Seller by Buyer(s) Veterinarian, Seller will provide Buyer(s) with replacement breed quality Kitten/Cat as soon as such Kitten/Cat is available to Seller.

Litter registration with The International Cat Association (TICA); for full registration only.

GENERAL

Buyer(s) and Seller agree that this agreement will be governed by the laws of the state of Tennessee and may not be altered, modified or rescinded unless agreed upon in writing by Buyer(s) and Seller. Any disputes arising from it must be handled exclusively in courts in that state. The prevailing party in any dispute will be entitled to recover reasonable cost and attorneys' fees.

Under the terms of this contract, Breeder has the right to investigate the care of said Kitten/Cat if circumstances warrant. If we feel said Kitten/Cat is not getting proper care and treatment, the Buyers(s) shall have 72 hours to return said Kitten/Cat along with signed TICA registration transfer to Kittens on the Prowl Cattery at Buyer(s) expense.

If buyer(s) fails to do so, Kittens on the Prowl Cattery shall have the legal right to repossess said Kitten/Cat and signed transfer registration form from the Buyer(s) without refunding any money. In addition, the Buyer(s) shall be liable for any expenses incurred in the process of repossession (including legal and court fees), and Veterinarian expenses to restore said Kitten/Cat to good health if necessary.

If it is not possible for the Buyer(s) to return said Kitten/Cat and TICA registration form, Kittens on the Prowl Cattery will recover the greater sum of $2500.00 to have said Kitten/Cat, as damages for Breach of Contract.

Kittens on the Prowl Cattery neither makes nor implies any warranties or guarantees, express or implied, other than those written in the agreement. This document constitutes the entire agreement between Kittens on the Prowl Cattery and Buyer(s) with respect to this sale.
